I'm sure the way it has always been, is that if the tuner is in your main signal path, then it counts as a pedal (even if it is a non-footswitchable tuner), but if it is not in your main signal path (e.g. you're using a tuner out on a volume pedal, or 'spare' output from a stereo pedal) then it doesn't count. I got so sick of that that I decided to flip it up to old, analog and fat.
