You: Hey, I ordered one guitar, got one 4x as expensive..

Salesdude: Yo man, no problem, you keep that bad boy..

You: yay!

Conversation 2:

Salesdude's boss with their coporate lawyers on speakerphone: Yes, Salesdude has been fired for making business decisions well above his authority level and now you either owe us the difference in price for the guitars, or the return of the one you got. If neither of these occur, we sue you.

You: Doh!

Seriously, I hope you get such a nice gift from an uncaring company, but get it in writing, call a supervisor, something to cover your ass before you decide that Christmas has came early. Companies aren't in business to upgrade a $1400 purchase to a $5600 purchase because of a backorder. The guy that told you to keep it might be seriously disgruntled, might have been on his last day, might have been on his first day, any number of reasons. Bottom line, cover your ass before you find yourself in serious trouble for taking advantage of that little shipping error. It might cost you dearly.

Forget that. The error was already pointed out and they did not want to correct it. The end.

I'm with Raven here...cover your ass!! Someone at that company will pay the price for this mistake. And it eventually may land heavily in your lap! Don't assume everything is OK here. Get it in writing or something. If it's too good to be true..it probably is!

to me, it sounds like you hit the jackpot.

something similar happened to a buddy of mine with a used mesa boogie amp he bought online from guitar center.

end of story: my friend got 2x $1400 bass amps for the price of 1.

he kept calling (for a few months) to let them know, they kept telling him someone from fedex would come by and pick it up... no one ever showed. 2 years later, he sold it for $1200.

Personally I do not believe it is good fortune or karma to profit from some else's mistake. I realise there are those who disagree.

Anyhoo................... 1400 paid and 5600 delivered?

Get it in writing.

At the very least write, not email, the place (not the sales guy) and state the facts in order. Give them the opportunity to reply. That will be to your advantage if they realise the difference between profit margin on a 1400 sale and on a 5600 ticket sold for 1400.

It cannot do you any harm and a court will smile upon your attempts to draw attention to the issue.

I'd have kept it and not called.

and the idea that you could get in any kind of trouble is laughable. you're safe.

Yeah, just keep yer head stuck in the sand and nothing bad will ever happen to you.. Right? Laughable indeed.. At least a few people here have the brains to understand that when something like this happens, it's going to come out of someone's pocket eventually.

Thank you all for your input and suggestions.

Gas Man, those pictures are pretty accurate.

I checked the card, and the charges are what I agreed to.

I sent an e-mail and got what seems to be a form letter back, basically telling me the same thing as the salesperson. I've got 45 days to return it if I don't like it.

I would have expected them to send me a pre-paid return shipping label since it was their mistake, and then give me some kind of reward for being honest -- although I wasn't being honest to get some kind of reward -- it was simply the right thing to do -- I just wanted to send it back and get the guitar that I paid for.

New Mojo MIDI Flys sell for about $4200.

Mojo Flys without MIDI sell for about $3300

So unless the retailer changes their mind soon, I'll be putting it up for sale. I'll ask $3500 for it.

I feel really weird doing this, but I gave them two chances to take it back without me paying for return shipping. I guess I'll consider it good Karma or just plain dumb luck.

I would have actually been happier if I got the DragonFly that I ordered. It would have been less complicated.

No need to cover your ass, Notes.

An online retailer cannot demand payment for shipping something more costly than what you ordered... & it would be against the law for them to do so. The laws go back to the early catalog days of Sears/ Roebuck & the like when companies would send out merchandise that people did not order and then demand payment.

Even so, you've already done your due diligence by informing them of their mistake & they told you to keep it. Case closed.

PS:

Look at the first Q&A:

That doesn't cover erroneous shipments, just unsolicted ones. If MF sent me a guitar tomorrow and demanded payment, they'd be SOL and I'd have a freebie. But if I order one and get the wrong one, I'm obligated to return it or pay the difference if they demand it. On a few hundred bucks, they probably wouldn't fight it. For a few thousand? Yeah, they'll fight that. I'd either return the thing or keep it cuz this is not over. Print out this post, stick it in yer wallet and look back on it when they come callin in a few weeks or months.. Come inventory time, someone is gonna notice.

oh, and per that link, here is what you need to do:

Q. What should I do if the unordered merchandise I received was the result of an honest shipping error?

A. Write the seller and offer to return the merchandise, provided the seller pays for postage and handling. Give the seller a specific and reasonable amount of time (say 30 days) to pick up the merchandise or arrange to have it returned at no expense to you. Tell the seller that you reserve the right to keep the merchandise or dispose of it after the specified time has passed.

Keyword there being WRITE.. As in a physical letter, which I'd also get notorized and send certified mail. Follow that, you're in the clear after 30 days.

I can see where you're coming from.

I'd have done the same thing, because in all honesty, it's a bit of a hassle to flip one super-expensive guitar so you can buy the original expensive guitar you wanted.

Were I in your shoes, I'd go through the hassle of selling it and buying the original guitar I wanted. :thu:

It sounds to me like you got a good deal. You tried to be honest. They admitted their mistake and told you to keep it. Still, I understand the desire to send it back. I probably would have done the same thing.

This. You were honest and they said you can keep it. It's yours to sell. So take advantage of it, sell it for a hefty profit and enjoy yourself. Lucky bastard....

I wrote and posted the letter today. Now comes the waiting game.

Since it's a Federal Trade Commission site, I have confidence that the information is correct.

I feel much better now, knowing I did the right thing, and in the proper way.

Thank you all for your help and suggestions.

Whether they want it back, or if I put it up for sale next month, either way is OK with me.

Good call Norton, I'd do what you're doing. Due diligence, and if it's meant to be, sell the guitar and hope karma doesn't bite you in the ass with a bad eBay buyer :D

Side note: I've wanted a Parker forever. Why aren't they super cheap :(

:(

They had some Korean ones a few years ago, my partner picked up a PM10 for about $500 - not super cheap but a great price for that much guitar. It's a single cut LP style guitar with coil tap pups.

Looks like this one:

The DragonFly goes for $1400 and you can get it for less. Not super cheap either, but some great technology with a vibrato that can be locked, down only or floating, a fishman pizeo, and ssh duncans with the h coil tapping.

Since I play music for a living, I can justify (rationalize) the cost.

So in a way it's a super-strat. I've always wanted a strat-ish guitar, but I hate short radius necks. Fender does offer one model with a 12" radius, but it has the dreaded gold hardware, which in Florida will look ratty in about 2 weeks.

So between the pups and vibrato (I refuse to call it a trem) I should have a very versatile guitar. It has the strat-ish shape, which I like and it's not heavy (5 pounds, that's lighter than my ES-330 or Casino). I'll probably eventually replace the humbucker with a p-rail. That will give me just about all the sounds I'm capable of doing anything with for a long time to come.

And I've convinced myself that just having the new guitar will improve my guitar playing :)
