Members guitarcapo Posted April 28, 2011 Members Share Posted April 28, 2011 I think if it's a private citizen, you have to have a signed "release" in order to use photos or video of someone if the video or stuff was taken in a place where the subject can assume "reasonable privacy" like indoors in a residence (not out in public)....I don't know how it all works if the subject is AWARE they are being filmed but I would doubt you could just distribute that stuff without the subject's permission...otherwise there wouldn't be "release forms" that had to be signed for people caught on hidden camera on reality shows. The laws change a lot when you become a "public figure" but any other citizen is allowed privacy by law. The whole "public figure" issue goes back to the founding fathers wanting all politicians to be subject to scrutiny through freedom of speech and unable to retaliate against negative press....and like our "right to bear arms" laws...got all perfeverted to the point where you can take pics of Britney Spear's cootch as she's leaving her car.
