No problem here....the only flat land on my acreage is on the top, and that's where the house and barn are.
It's pretty tough to get a pond to sit still on a 45 degree slope.

But in a similar vein, there are some pretty serious land-use laws around here concerning pond-safety....as in, you need to have a overflow and flood-mitigation plan in place, in case your levee breaks.
