DaVinci and Copyright?

I'm planning on using some of DaVinci's sketches as the artwork for my album (the concept is paradigm shifts). I was wondering if I am allowed to do this or if his sketches are copryrighted. I know music can be used freely once the artist has been dead for X amount of years but is artwork the same?

I could be wrong, but isn't the photograph of the sketch subject to copyright? You would probably want to make sure that the photograph is in public domain if so.

 

 

 

I was thinking the same thing... He would have to go take his own photograph of one of the paintings....
