There goes my research buget BTW, a Trademark does not have to be registered to be upheld in a court of law, but it doesn't hurt if it is. Businesses everyday across the country trademark their property without registering it with the Patent and Trademark Office. However a lawyer could tell you better whether it would be a better idea in your case. If it's something you want to blow up, take national, and/or sell to investors it might look better if you took this step. It's also possibly a step you can take when your in better financial circumstances if you plan on starting small. However, as I said first document, document, document.
