Tribute band - legalities?

Hi everyone.

I was wondering if anyone knew the legalities of performing in a top-notch "tribute" band.

 

i.e. royalties need to be paid?,

can you perform the music without permission?, is this something to even be concerned with?

It depends. If a band wanted to, I am sure they could make a case against you. The Beatles tried to stop tributes and failed. The courts said it was legal. I am no lawyer. I myself am Gene Simmons in a KISS tribute band. KISS has no problems with tribs as long as they don't try and decieve people in ads, etc. they feel it helps keep the band ALIVE! To me they are right. After a trib plays a town, how many people go out and get a CD of the band they emulate. Trib shows are just nostalgia shows that make people remember younger days feel good. On that note, IF YOU ARE GOING TO DO A TRIB ACT DON'T LOOK AT IT AS EASY MONEY. YOU HAVE TO GIVE 100% EVERY NIGHT, TO LOOK AND ACT LIKE THE BAND YOU EMULATE. It is NOT easy being someone else. Aces - the band is already formed.

We are a Pink Floyd tribute, we don't have any noteable competition in MI, but Ohio has 'Wish you were here".

Nonetheless, I've done much research and I honestly believe that vocally, musically, and looks wise we will be better than most.
