We are recording our Album towards the end of April and its being released through a independent label local to us.

 

We have released two EP's through the label so far without anything formal in place other than spoken agreements between us and the label.

 

The label is looking to secure us now, to protect themselves (and us of course) and are drawing up a contract/agreement...

 

What sort of things should we be keeping a lookout for? We know things like % of sales, song rights but is there anything that might pop up further down the line?.

Definitely +1 on the lawyer.

 

No matter how friendly or trusting or honest your relationship is with anyone, business is business. Better to be safe now and take the necessary steps than to learn the hard way later and regret it.

 

If anyone ever is offended or tries to dissuade you from using professional counsel, that should be a big red flag that something is wrong.

Get a lawyer...I don't care what kind of relationship you already have with the label.


Get a lawyer.

And a lawyer who specializes in this area, not some guy who draws up wills...

I know several friends personally who got caught up in that, broke their contract unknowingly, and owned THOUSANDS of dollars in back-recording/mixing/mastering time.

I always say, the very best time to find out that somebody intends to screw you over is when they balk at putting your agreement in writing! Better to find out then, than down the road after you're already committed & it's too late!
