Members burdizzos
There is a cap on punitive damages in Texas. The settlement was just reduced to $26 million. link
Members J.
Judging from just the facts at hand I think the payout (even after the cap was applied) is ridiculous. Not quite as ridiculous as some of the settlements and judgements people are getting from tobacco companies (for crying out loud, you chose to smoke), but still ridiculous. A company has to make a {censored}-ton of money on a new drug to recoup development costs and fund development of other drugs, those 8 - 12 years or more a drug is being developed they make no money and there is no guarantee they ever will. Speaking of which, do you know what percentage of drugs never make it to market? BTW viagra was in clinical trials as a blood pressure medication when the clinicians noted many subjecs where asking for more, they asked why, and Viagra was born. Believe me, they make MORE than enough. Their expense accounts are gi-normous!! They don't need to charge as much as they do. They only do because they can (the U.S. is the only country in the world that does not negotiate pricing with the drug companies).
Members gspointer
Yeah, I used to work in the industry, the execs are overpaid like everywhere else, the rest goes into R&D and keeping good people.
