against conventional wisdom i decided to put my electra corsair up on ebay:

i worded it correctly and gave an accurate description of the bass. nowhere in the description does it say rickenbacker or any of the other "trademarks" that rick has in a way that is not nessecary to give an accurate description of the bass. i got 2 bids,180 views and 4 messages in the first hour it was listed.

now, i know i'm a glutton for punishment but the curiosity of what ebay's excuse will be if/when they pull the auction just got the better of me.

we'll see :)

looks like prickenbacker had my auction pulled .here's the excuse ebay gave me:

I was wondering why you even put the word "Rickenbacker" in there.


It was sure to get pulled on that alone.

 

 

it has a rick pickup in it. if it was any other brand of pickup i would have had to put that in the description as well (full disclosure and all).

and don't get me wrong - i'm not pissed - i had a pretty good idea what would happen. i just thought the ric-o-cops would have a better excuse than "well it kinda looks like a bass we made 40 years ago that we didn't get around to trying to copyright untill it was too late"

I suppose. And it is BS. I mean, do they honestly think that stopping the circulation of these copies is going to change anything? They're out there. And they're not going to magically disappear.

 

Next time, put it like this:

 

Electra Corsair (bla bla bla)

 

...the neck pickup was made by a company whose instruments this one here resembles. But I cannot attach that company's intellectual property to this listing because they don't really seem to have better things to do, than police online auctions for product that is similar to theirs.

There was nothing in your posting that violated any intellectual property laws. I'm thinking I should list it for you and when eBay sends me a similar message I can respond accordingly.

the only thing i can figure is this part :

it just seems to me like everything that was made before rick took out their trademarks ( how in the hell do you get a trademark for a piece of wood in a certain shape????)

should be exempt from these sorts of things. ric is just doing this whole thing on a technicality.

 

the funny thing about it is that i've made twice as much money for ebay as ric has :rolleyes:

Yeah it looks like a ric, but you didn't list it as such.

It has a ric pickup. What, you can't sell ric pickups?


:idk:

 

 

 

that's my whole gripe with it. theoretically if i was to sell the bass without letting the seller know that it had a replacement pickup (whatever the brand may be) i would be liable for misrepresenting the bass and would be resposible for a refund on the transaction and paying return shipping and all the cancelled ebay fees.
