Magazine publishing...

I have a question about publishing a magazine both online and off.

For the sake of argument I will use the title "Zeeface", (I know funny right? I used that because the actual word is somewhat unique.) Anyway, I have been working on a music magazine concept for quite some time now. Come to find out there is an existing website that is named Zeeface . com. This website is also music related, but has nothing to do with any sort of magazine. The owner of the website has the name "Zeeface" trademarked as well.

My question is this: Even though the name/word "Zeeface" is trademarked can I legally still use the word Zeeface and add the word magazine, making the names/words I want to trademark "Zeeface Magazine"?

Thanks for any help.

you are treading on thin ice since someone trademarked the name in relationship to a music enterprise, and they are likely to protect their TM, but I would guess with a c&d... since the name is in use, think up a new one...call it Xeeface and move on...
