I dont have it. I contacted the post office on friday and saturday and they are supposed to call me monday after they talk to my postal carrier.... ever happen to anyone? what now?? the seller did have insurance on it.... what is the next step if it isnt under the seat in the USPS truck.... edit : oh yeah it was a keeley mod bd-2 Link to comment Share on other sites More sharing options...
Members amp_surgeon Posted April 14, 2008 Members Share Posted April 14, 2008 If the seller waived signature confirmation, and the package shows as delivered, then he probably can't file an insurance claim. Normal insurance coverage is only $100. If he bought additional coverage, then it shouldn't be possible to waive signature confirmation. Find out if the seller specified signature confirmation. If so, he should be able to find out who signed for it. If it was delivered to the wrong party then he's got an insurance claim. The mail carrier is NOT supposed to sign off the package as delivered unless he actually physically placed it at the delivery address. The only exception is drop shipments, which are considered delivered when they arrive at the destination post office. BTW, this is a prime example of why I ALWAYS insist on signature confirmation. I've had a few people get ticked off at me because they came home from work and found a pink ticket on their door instead of a pedal on their doorstep, but I haven't had a pedal disappear yet. I order a fish n chips almost 2 weeks ago and it hasn't come yet. Their tracking numbers they send me never work either. I love sweetwater but they don't carry danelectro and that sucks. MF is usually a matter of a 3-4 days for me if something is in stock.... I have had one instance where I made an order and it turned out to be out of stock.... they notified me and gave me a full refund so a purchased the same product at a different site. It's their responsibility to see that you get the product you ordered. The courier is their agent - not yours. If the courier screws up and loses your package, it's up to the seller to make it right. Their responsibility ends when the courier confirms delivery - not pickup. in this case the seller is Amazon. they told me to contact fedex because the tracking number already showed that in made a few stops across the continent. maybe I should of put up more of a fight, but at least I did have proof that it was fully on its way here. B/c of that I cant blame the seller. Its not like he didnt try. I have called the supervisor of my post office 2x now. Both times he said he would call me. He didnt Friday. I called Saturday, he didnt call today. Im going down there before work now. Too bad its a federal business, cause I would raise hell if it was a walmart or something. The postal service is responsible to the sender, who is in turn, as the seller, responsible to the buyer. You are correct. The seller is the one who makes a contract with the courier to deliver the product. Therefore, the courier is an agent of the seller - not the buyer. If the buyer were arranging for their own courier to pick up the package, then the seller's responsibility would end as soon as the courier picked up the package. This topic comes up all the time on the "Sellers Central" forum at eBay. The consensus there is always that the seller's obligation to the buyer doesn't end until there is confirmation that the package has been delivered. PayPal and eBay agree - they will refund the buyer's money if the seller can't prove the item was delivered. Having said all of that crap, the courier does have an obligation to the seller, since the seller is paying them to perform a service. If they fail to deliver the item as agreed, then the seller has a claim against them. However the seller resolves the matter with the courier, he still should make good to the buyer. Tracking said it had been delivered 15 minutes before I checked it and it wasn't there. Called them immediately and they were able to contact the driver. Not only did they return it, when I went to pick it up to send out again they "couldn't find it."Of course, the one time I don't buy insurance on an item, it vanishes. At least it wasn't big-ticket. I was so uber polite about it. Did the "smile in my voice" thing... nothing.... didnt call me back AGAIN... I have half a mind to now further my complaint higher up in the post office. now, not only am I probably out a pedal... Im getting rude postal officials when they lose my stuff....
