In short, if you didn't order it, it's a gift. You're a little bit confused. Not just about the FDA part, but also about your assertion that a screw up by a company, which you entered into contract with, somehow entitles you to a free gift.... that is not the same thing as some company sending you something completely unsolicited and then later sending you an invoice for it, which is what that regulation you are referring to is all about.
