                Absolutely. McConnell and the Senate planned for that and accomplished it for the SCOTUS by refusing to hold hearings on Obama's nomination. McConnel cited the "Biden rule," which was neither law nor constitutional mandate. McConnell was, and still is, acting like a filthy SOB.
                For those who prefer to listen rather than read and who ask these questions: What underlying crimes were being investigated when Trump obstructed justice? Why wasn't he indicted? Why did Mueller discuss indicting a sitting president in Volume II but not Volume I?

                    You just have to take Trump's word for it that he's been "completely exonerated."
                    Then ignore the four-hundred-or-more pages where Robert Mueller said he isn't.
                    In fact, Mueller himself has said his report does not "exonerate" the president.
                    The only reason he -- Mueller -- didn't indict Trump is that he doesn't think the
                    Justice Department has the legal standing to try a sitting president on criminal
                    charges while said president is in office.
