SCOTUS has already ruled that the POSTUS doesn't have the authority to steal money from the DoD/Homeland security. For the POSTUS to invoke what he wants to do, the emergency must have to be unusual and unforeseen. Neither are true here

SCOTUS has ruled that declaring an emergency doesn't give POSTUS the power nor authority to seize privately held property. So all those who own land along the border, it will be years, even decades before the donument crosses private land. IOW, a emergency declaration doesn't give the POSTUS the power or authority to usurp the constitution.
