I had about 7 beers last night throughout the evening. Pulled into a casino parking lot around 1am.....fell asleep in my car! A cop knocked on my car window around 3am....put me through the typical tests...walk in straight line, follow pen with eyes, say alphabet. I felt that I passed all of them. I refused a breathalizer, so he arrested me, cuffed me, took me to the station. They had me do a couple more tests, then took a blood sample. I was finally released early this morning. I made sure I was very courteous & cooperative. I may hire a DUI lawyer (someone recommended me a good one). I'm worried it'll cost $3000-$5000. If so, I may just have to take my lumps & deal with it. 2nd DUI though....I got one 23 years ago. If anyone has any suggestions or has gone through this, I'd appreciate it. I have a professional job, & 2 kids. At this point I'm scared. And done with drinking....it's just not worth it. Link to comment Share on other sites More sharing options...

DDidn't know that they could do that. How long after your first beer did the blood test occur? Sucks overall that you were sleeping in your car and not driving, yet they still pulled this ****. It's not a moving violation!Just say you got drunk in the establishment associated with that parking lot (or somewhere else), then walked to your car and fell asleep there without the slightest intent of driving it while intoxicated.Lawyer ... Some go to jail with 2. The biggest mistake you made was to not take the keys out of the ignition. If there are no keys there, the cops can't claim driving. Isn't there mandatory time for loss of license? If Someone gets nailed then it's like 6 months or 1yr loss of license not matter what'. What's the lawyer going to actually be able to do for you?? No remorse, you drove while intoxicated. Should have got a DD. I play many gigs sober and go out with friends sober. If I drink, I make plans to have someone pick me up or a taxi. Yes this is true,If it sticks. Was every thing done according to the letter of the law.? Is there any gray area in the law? Anyway, you've got a 50% chance of getting the charges lowered if you throw 3-5k at a lawyer. It's going to cost about the same if you do nothing. Most DUI fines run around 1-3k when it's all said and done. Depends on your state and how tough they are. So basically be ready to toss money around like crazy. That's what they want. Members rvschulz Posted August 7, 2013 Members Share Posted August 7, 2013 in Louisiana (and i suspect most states) you will get a suspended license. in order to drive legally, you can apply for a hardship license. that requires signing an 'SR-22" which then requires special insurance AND a breathalyzer machine in the car. for my son, the insurance was $300/month for liability only, and $90 a month for the machine, and $250 to get it installed.he was immediately dropped from the family insurance. he didn;t move quickly within the 30 days you have to appeal the suspension, and then got caught driving under suspension. additional 1 year driving suspension. when he got his 2nd DUI, instead of a 6 moth suspension, he got an additional year suspension regardless of the outcome of the criminal case - DMV and criminal court are 2 separate entities.so, for 2 years, he did not drive. regardless of whether any of the thread respondents think they are not drunk on 2 beers ... is it worth it ? i am just stating the facts about what you might get into as this goes on. i bet a few of you can't afford a $300 month car insurance + breathalyzer machine costs to drive around. when you get caught here now - new law since my son's occurred - driving under suspension due to a DUI and no breathalyzer is an automatic 6 months in jail. DA can refuse to prosecute if you 'know someone' but the judge has no choice if it gets to him.if you think that a couple of beers is not too bad ... that add-ons become a serious screw up. Jail ? with a family ? or a girlfriend ? what about that job - they don;t hold that for you. you paying for a car ? bet it's repo'd ... house mortgage ... cha-ching, foreclosure.c'mon y'all ... think. how about that impending divorce because your wife can't take it.
