Members gpaaib
I have a question about publishing a magazine both online and off. For the sake of argument I will use the title "Zeeface", (I know funny right? I used that because the actual word is somewhat unique.) Anyway, I have been working on a music magazine concept for quite some time now. Come to find out there is an existing website that is named Zeeface . com. This website is also music related, but has nothing to do with any sort of magazine. The owner of the website has the name "Zeeface" trademarked as well. My question is this: Even though the name/word "Zeeface" is trademarked can I legally still use the word Zeeface and add the word magazine, making the names/words I want to trademark "Zeeface Magazine"? Thanks for any help. Gary
Moderators daddymack Posted February 12, 2016 Moderators Share Posted February 12, 2016 you are treading on thin ice since someone trademarked the name in relationship to a music enterprise, and they are likely to protect their TM, but I would guess with a c&d... since the name is in use, think up a new one...call it Xeeface and move on... Phil O'Keefe
I'd recommend discussing this with your attorney. I suspect they would counsel you to pick another name and avoid the possibility of legal tie-ups over it, but I'm not a lawyer...
Moderators daddymack Posted February 24, 2016 Moderators Share Posted February 24, 2016 nor am I, but I have reviewed similar issues with both trademark and IP attorneys over the years, hence my suggestions.
Members Scafeets
There's virtually no chance you can use "Zeeface" in your magazine or web title if another company is already doing so. Take it from someone with 20 years' of magazine publishing experieince.
