Good evening,

 

Last night my fiance and I hosted a party at our house. Located in a city pop about 18 K and we rent an old 4 bedroom house and in the back yard there is a 2 car garage. Invite family and friends over and drinkin' carrying on and eventually we fire up some karaoke tunes. It's a double lot so we are on a acre of land. The one neighbor to one side I talked to earlier and had told him we'll be having some music later on and invited them over. The other neighbor is friends and were actually partying with us. Anyhooo...I guess it did creep up volume wise (2 mrx 518 and 2 mrx 515's, crown 4000 watt amp bottoms and yamaha 2000 watt tops) and neighbors boyfriend was at home and heard our address on the scanner, cops on the way, no sooner than I heard it passed to me (was singing dirty deeds done dirt cheap) at the end I said concrete shoes, cyanide, ***** PD! "done dirt cheap!" look over and he's standing in the garage asking who lives there. crap. I was thinking I still had time to tune it all down and play the stupid card.

 

Anyway, very very rude officer and very agressive. You know 18,000 questions with out stating WHY. So I'm like sure I'll give you my name AFTER you give me yours, badge #, your supervisor's name and the reason for your visit? We have a complaint, what type of complaint may I ask? We can't disclose that you have to come to the station on Monday for that info. Anyway so I'm a prick back to prick. Another officer came in and politely said hey it's loud and we can hear it 4 houses down the street, ok we can respect this and I'm nice back to the officer. I know in the past I've done live stuff at people's houses and I even called the chief of police and asked about permits etc for noise ordinances. Well get this you can't even apply for a permit, however the city can apply for a permit for big huge acts that play downtown for city events.

 

Ok got my verbal warning no problem we will turn off, then he says I have to ask you to ask all these people to go home. Now THAT I objected to, sir there is no law that states I have to ask my guests to go home and I'm sorry I will not do that. All of these people are staying here tonight because they have all been drinking and that's what's going to happen so they are not leaving. He said well we are supposed to ask you to that..and if we come back we will cite you. I know talking to the chief that's what he said, if we get a call you get a warning, if we visit a second time you will probably be cited and a 3rd time arrest.

 

Later on we have music off and we are drinking with the fire going shootin the **** and 3 dudes come up the driveway, yo what's up, we are 3 houses down and the police busted up our party (college kids), so what I'm thinking is that when they busted the party and heard my music hence paying us a visit.

 

I don't know that seems to be a violation of my rights to FORCE me to ask my guests to leave...thoughts?????

Telling you to send your guests home on a "warning" seems kinda "Totalitarian", to me, as you'd already agreed to turn the volume down.

Seems like that is a pretty hard hitting sound system for this kind of event in that type of neighborhood. We have swing dance parties at our house and I use one EV ZX1-90 (8" speaker) powered by a Yamaha EMX512SC turned up about 1/4 of the way. I live on a large farm with no neighbors, so I could go as loud as I want. I'll admit, I just don't like loud music. Anyway, do you have any idea of how loud it was (decibel meter)?

Ohhh I don't know probably pretty loud, no meter so hard to say. It doesn't take much for those JBL's to cut, sure do sound nice!

The mention of college kids in your post makes me wonder if you live in a college town. If you do - nothing about the police's response is surprising in the least. College town law enforcement is focused on two thing ... 1) keeping the kids in line and 2) maximizing revenues. My experience around colleges towns is that it's a zero tolerance game when it comes to amplified music out in the rental subdivisions adjacent campus - as well as a great revenue opportunity if there's any underaged drinking going on. If there's anything I'm certain of - it's that the last thing the police are interested in is a debate about what your rights are situations like this. You certainly won't get anywhere even thinking about debating was constitutes "too loud". Ordinance enforcement is justified solely on the suggestion that they've received a complaint. Trying to debate with 'em after that - just gets ugly.

Indeed no debate! Once I was treated like an adult and approached what the issue was system was turned off and told them it would stay off. It is a college town, however it's a residental neighborhood (all houses not apartments) and the students that had their party busted 3 houses down obviously rent that house. I never debated, said yes sir it will be off the rest of the night, however, the average age at my house was 30 +. Not college kids, just some of us middle aged, making a living, raising a family and paying taxes kinda folk. I don't think a complaint was registered to be honest, they just so happen to hear it being in the neighborhood.

 

We have had a parties in the past one one neighbor let us know it was too loud and we turned it down was the end of that.

the law doesn't care if you are 21, 31, 41...it doesn't care if you rent or own...and I'm with mooger: even if the cop is being a total dick, he may be looking for a reason to 'up the ante', so do not give him that reason. Be cool, remain calm, be polite, get his badge number... and invite to come back for a beer when he gets off duty....and tell him to bring his friends.

Yes sir and no sir without ever admitting to any form of guilt has kept me out of a lot of {censored} in my much younger years. And cops have been there and helped in most of my chance meetings with them.

 

Matter of fact, I had a Mississippi Highway Patrol officer offer to give me money to repair a busted radiator hose just south of Granada. I didn't need his money but he did take my wife and son to the nearest exit while I waited on AAA

I was stopped by the Tennessee high way patrol for speeding, I think I was about twice the limit, put on my best Prince Charles accent and I think he thought I was James Bond anyhow a bit of schmoozing and he gave us an escort to where we were going. So as with everyone I meet my philosophy is be nice, be nice, be nice and if it's not working become nasty real quick or better still run away.

I don't think the police have the right to ask your friends to leave over a first-time noise complaint--there would have to be a clear and present threat to public safety or repeated failure to comply with the law. But I'm not a lawyer, so perhaps someone can confirm this?

I believe they have to declare it an unlawful assembly. I would think doing that at a private residence would be a stretch unless there were some extreme circumstances. I don't think playing music too loud would be considered extreme.

I'm about sick of jack boot, federally trained cops acting like THEY are the law, violating our rights and bugging their eyes out at us, the American citizens they are supposed to "protect and serve". I have nothing to say to them. If they came to my house, I know the EXACT laws and ordinances. I would tell them politely I'll turn it down but to get off my property unless they have a warrant.

 

Do yourselves a favor and avoid cops. This new cadre are bad bad news. I don't know about you but I'm my own cop. I recommend arming up, learning how to protect yourself and obeying all laws. If you need to call them to report an incident down the line do so but other than that steer clear of them. Police ARE NOT the keepers of the peace they once were when my grandfather was a captain in Westfield, NJ.

I was in law enforcement several years ago, and went on lots of disturbance calls. 99% were no big deal. If there was band we'd usually listen for a minute before making contact. We tried to be as friendly as we could...we'd say the band is good but a bit too loud...most of the time folks turned it down a bit. We NEVER told anyone their company had to leave.

And you don't want the off duty officers to show up....you wouldn't have enough beer.

 

 

Edit: Okay, I gotta confess if we noticed a few folks there who were majorly drunk we would wait a few blocks down the street. As cars would leave the party we'd watch how they drove. The ones who weaved alot got stopped.

Absolutely...it's always better to tell the officer, "Oops, things got out of hand, volumewise, and we'll be more careful!", then walk over and turn it down considerably, asking "how's that?".

Yeah, I am not sure I get the complaint, either. Rocking little tune. Lyrically weak? Yeah. But, of all the crap on country radio these days, Dierks does not cause any issues with me

I just played a wedding last Sunday at a house "halfway" up a mountain. Expensive area, the house was very impressive, even had an elevator in it. Anyway, it was a four piece band doing some Jazz, Soul and Motown. We were playing in an outdoor courtyard that did not face the mountain view. We played one set and the police showed up around 10:00 pm. They didn't shut it down but stated that they had complaints coming from "miles" down the moutainside and we would have to call it at 11:00 (which was the scheduled time anyway). It wasn't loud, I was just using two Yorkville NX350's, one for the keys and one for the vocals, but there must have been some kind of funneling effect.

 

It's my feeliing that because the owner had money (lots) and also knew how to converse in a manner the police could relate to, we were allowed to continue and finish off the night. I know that I've been in similar situations and have been shut down right away.

it's trite and inane just like the people who bought it. The music is cool but the lyrics are a needless wasteland of idiocy...But then I guess this describes our society at large which is reflected in our popular music...So forget it. Back to your regularly scheduled programing. :wave:
